What is different about buy-to-let conveyancing

Buy-to-let conveyancing differs from owner-occupier conveyancing in six respects. The conveyancer confirms the mortgage conditions permit letting and that the lender has approved the borrowing structure. It files the SDLT return with the 5% additional-property surcharge, in force in England and Northern Ireland since 1 April 2025, and for a company purchase over £500,000 checks whether the 15% flat rate applies or a rental-business relief displaces it (gov.uk SDLT rates); the surcharge and rates are set out in stamp duty for landlords, and the stamp duty calculatorchecks the figure on the completion statement. For a company purchase it adds director guarantees, board resolutions and Land Registry registration in the company's name; company purchases add director guarantees and lender approval of the special purpose vehicle. For an HMO it verifies the planning use class and whether the licence transfers. For leasehold it reviews lease length, ground rent, service charge accounts and any covenant restricting letting; leasehold checks matter more after the Leasehold and Freehold Reform Act. And for a tenanted property it collects the tenancy agreement, deposit certificate and the certificates served at the start of the tenancy, because those liabilities transfer with the property.

Solicitor or licensed conveyancer

A licensed conveyancer is regulated by the Council for Licensed Conveyancers and qualified in property transactions only; a solicitor is regulated by the SRA and can also conduct litigation. For a standard purchase a licensed conveyancer is usually cheaper and at least as fast. For a company purchase, a short lease, a title defect or a tenanted property, a solicitor's broader training is worth the difference, and a landlord-specialist solicitor is worth more still. Both carry professional indemnity insurance and both can be verified on their regulator's register.

What buy-to-let conveyancing costs

Expect £1,000 to £1,800 in legal fees for a standard purchase in personal name at the online and panel firms, £1,500 to £3,000 at a specialist solicitor, plus supplements of £150 to £500 each for leasehold, company purchase and lender work, plus disbursements: searches (£250 to £450), Land Registry fees, bank transfer fees and the SDLT itself. Conveyancing fees are capital costs, set against the gain on eventual sale rather than against rental income. Ask every firm for a quote that lists supplements and disbursements separately, and treat a headline fee with no supplements listed as incomplete.

From working with landlords across the UK, the conveyancing problem we hear about most often is not fees but the lender panel: a landlord instructs a firm, the mortgage offer arrives from a lender the firm is not on the panel of, and the lender's own solicitor is appointed at the landlord's cost. Confirm the lender before the conveyancer, or confirm the panel before the offer.
